The Employment Rights Debate

The new coalition government are considering changing the qualifying period for an employee being able to instigate tribunal proceedings from 1 year to 2 years, this is in response to the view from the business community that the tribunal system is biased to employees allowing for scope to bring spirious and claims without foundation.

Consequently companies are being exposed to huge costs to defend claims which have limited or no foundation. This situation is also being fuelled by the the no win no fee legal brigade knowing that the impact on costs, resource and reputation is driving organisations to settle claims rather than proceed all the to a full blown tribunal hearing.
